NATURE OF SERVICE

Welcome to Therapy with Ashna! This practice consists a of psychotherapist who is Trauma-Informed, Queer Affirmative, and skilled to help clients with a variety of problems. The therapist has a Masters degree in Counselling Psychology, alongside additional training.

Offerings may include:

Online or (in special cases) face-to-face consultations.
Workshops and webinars with the therapist and other qualified practitioners from the field.
Self-care tools along with resources on the website

This document contains information about our professional services, business policies, and terms and conditions. The signing of this document will represent an agreement between the sole proprietor and the client.

BOOKING PROCEDURE

To book a session with the therapist, you need to go to the website and from the services section choose what will best suit your needs. Please note: In order to confirm the slot for the session you would have to make the payment within the next 2 hours or else the session will automatically get cancelled. After booking and payment, you will receive a confirmation email along with the meeting link on your registered email ID.

DISCLAIMER

Therapy with Ashna does not deal with medical or psychological emergencies. We are not designed to offer support in crisis situations - including when an individual is experiencing thoughts of self-harm or suicide or is showing symptoms of severe clinical disorders such as schizophrenia and other psychotic conditions. In these cases, in-person medical intervention is the most appropriate form of help.

If you feel you are experiencing any of these difficulties, or if you are considering or contemplating suicide or feel that you are a danger to yourself or to others, we would urge you to seek help at the nearest hospital or emergency room where you can connect with a psychiatrist, social worker, counsellor or therapist in person. The same applies in case of any medical or psychological health emergency. We recommend you involve a close family member or a friend who can offer support.

USER AGREEMENT

By choosing to visit avail any Services and/or resources from Therapy with Ashna, the user confirms that they are above 18 years of age and are not otherwise incompetent to contract under the Indian Contract Act, 1872, and are legally allowed to take decisions of their own. The user also accepts and agrees to our Terms and Conditions (hereafter referred to as “User Agreement”) and those additional terms and conditions and policies referenced herein and/or available by hyperlinks.

Please read the User Agreement carefully. The terms in the User Agreement are in effect upon your using or availing of Services or resources. Accessing the Service/platform on any medium, including but not limited to mobile phones, smartphones, and tablets, is also subject to the terms of the User Agreement.

We reserve the right to add, modify or remove sections from the User Agreement at any point in time during the course of the agreement with no prior notice. Continuing to use Therapy with Ashna, and purchase any Service or resource, forms an obligatory legal agreement between the user and Therapy with Ashna. The liability to review the User Agreement from time to time lies with the user. Continuation of the use of the platform after revision of the User Agreement will be deemed to be an acceptance of the revised terms.

For Minors: If you are below 18 years of age, you are legally mandated to ensure that these terms and conditions are read and signed by a parent/legal guardian/adult caregiver IN YOUR PRESENCE. Essentially, this means your legal guardian’s consent and your assent (verbal/written confirmation for undergoing therapy) are both required in order for us to conduct the therapy process with you. Your therapist will additionally take you through the process and address any doubts you may have, in sessions.

This User Agreement applies to all users of the platform, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

By availing any of these Services, the user irrevocably accepts all the obligations stipulated in the User Agreement, Terms of Use and Privacy Policy, and other policies referenced herein; and agrees to abide by them. The User Agreement supersedes any previous oral or written terms and conditions that may have been communicated to you.

TERMINATION OF AGREEMENT

At any point during the term of the User Agreement, the user shall be entitled to terminate the User Agreement provided all outstanding payments are settled, if applicable. Upon termination of the User Agreement, there may still be some information saved on our servers regarding the user. Should the user wish to remove this information, they will have to contact Therapy with Ashna at therapywithashna@gmail.com

Over the course of the term of the User Agreement, Therapy with Ashna can choose to terminate the User Agreement without citing a reason. Any payment receivable by Therapy with Ashna should be paid by the user in full within 15 days from the termination of the User Agreement. Any payment receivable by the user will be processed by Therapy with Ashna as per our Refund Policy.

During the course of the User Agreement, it is expressly stated, understood, and agreed by you (user) that you (user) shall abide by the following terms of use.

You are 18 years of age or older, not otherwise incompetent to contract under the Indian Contract Act, 1872 and your use of the platform shall not violate any applicable law or regulation;
All registration information you submit - either to us directly or through your organization - is truthful and accurate and you agree to maintain the accuracy of such information;
Your use of the platform is solely for your personal and non-commercial use. Any use of this platform or its content other than for personal purposes is prohibited.
Your personal and non-commercial use of this platform shall be subjected to the following restrictions:

You shall not modify any content of the platform;
You shall not decompile, reverse engineer, or disassemble the content;
You shall not delete or modify any content of the platform and/or Services, including but not limited to, legal notices, disclaimers, or proprietary notices such as copyright or trademark symbols, or logos, that you do not own or have express permission to modify;
You shall not use the platform and/or Services in any way that is unlawful or harms the Company or any other person or entity, as determined in the Company’s sole discretion.
You shall not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contents on the platform through which the Service is provided, without express written permission by Amaha.
You shall not post, submit, upload, distribute, or otherwise transmit or make available any software or other computer files that contain a virus or other harmful component, or otherwise impair or damage the platform and/or Services or any connected network, or otherwise interfere with any person or entity’s use of the platform and/or the Services.
You acknowledge that when you access a link that leaves the platform, the site you enter into is not controlled by the Company and different terms of use and privacy policies may apply. By accessing links to other sites, you acknowledge that the Company is not responsible for those sites. The Company reserves the right to disable links from third-party sites to the platform, although the Company is under no obligation to do so.
You agree that you shall pay all applicable fees on time. In case of late payment, Amaha reserves the right to levy a charge/interest on the outstanding amount.
You take responsibility to check the technical specifications required before making a booking for a session or before availing of any of the other digital offerings.

You may not host, display, upload, modify, publish, transmit, update, or share any information that:

belongs to another person and to which you do not have any right;
deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature; and
threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offense or prevents investigation of any offense or is insulting any other nation.

PAYMENT AND REFUNDS

By using the platform, the user agrees to pay all applicable fees and charges upfront to Therapy with Ashna. Further, the user agrees to be responsible for any telephone charges and/ or internet service fees that may be incurred in accessing Therapy with Ashna Services.

For more information on payment methods, charges, and fees, the user shall refer to the services section on the platform. Therapy with Ashna reserves the right to change any or all parts of the Payment policy without notice or liability to the user or any third party. The sole proprietor may increase the session fee by a small percentage once a year. This is done for various reasons including sustenance of the sole proprietor, expansions, and based on newer qualifications obtained by the therapist. A notice period of 15 days will be given to the clients before the fee hike.

All cancellations and refunds will be handled as per the cancellation policy mentioned below.

Therapy with Ashna reserves the right to change any or all parts of the Cancellation & Refund Policy without notice or liability to the user or any third party.

CANCELLATION POLICY

You may cancel or reschedule your appointment at any time. We request you to inform your therapist in advance. Cancellation of appointment with less than 24 hour notice, or failure to show up shall result in you being charged the session fee in full, for the missed appointment.

As you will be given a protected time slot, it means your therapist cannot offer this slot to anyone else. If a client cancels with less than a full 24-hour notice, they will be unable to fill that time slot, which will result in the loss of an entire hour from their work schedule. We would ask you to ensure that you keep your therapist informed of any upcoming holidays or other commitments you are aware of so that your appointment slot can be allocated appropriately.

CONFIDENTIALITY

All interactions which take place in the setting of therapy are considered confidential. This includes all interactions with this counselor, any scheduling or appointment notes, all session content records, and any progress notes taken during your sessions. Your therapist only shares your case information in terms of technical specifics and challenges with their supervisor, to learn how to help you better. No one apart from a qualified mental healthcare professional will know your case history. No names or identifying markers will be shared.

Confidentiality will be treated with an exception when matters on legal grounds or safety are concerned. This will be done only after a discussion with the client.

DECLARATION

“I have read and fully understand this document. All questions that I had have been answered to my satisfaction and I recognize that I have the opportunity now and in the future to discuss any question I may have with my therapist. I agree to the policies and procedures explained herein. I agree to accept therapy from you.”
